OctoDecks is a web-based lesson presentation platform developed and operated by Objects and Concepts Limited, a company registered in England and Wales (company number 13746187, registered address: 71-75 Shelton Street, London, England, WC2H 9JQ) ("OctoDecks", "we", "us", "our"). The platform allows teachers to build interactive lesson decks, run live classroom sessions with student participation, and export lesson materials.
Our services include the OctoDecks application (accessible at octodecks.app), the marketing website (octodecks.com), and all associated free tools published on this domain.
OctoDecks is intended for use by educators, schools, and education professionals. You must be at least 18 years old to create an account or purchase a subscription. If you are using OctoDecks on behalf of a school or other educational institution, you represent and warrant that you have the authority to accept these terms on that organisation's behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at hello@octodecks.com if you suspect any unauthorised access to or use of your account.
All intellectual property rights in the OctoDecks platform are owned exclusively by Objects and Concepts Limited. This includes, without limitation:
No part of the OctoDecks platform may be copied, reverse-engineered, decompiled, reproduced, distributed, republished, sold, or sublicensed without prior written permission from Objects and Concepts Limited.
Subject to your compliance with these terms and, where applicable, payment of the relevant subscription fee, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the OctoDecks platform for your own internal educational purposes. This licence does not include any right to resell the service, create derivative works based on the platform, or use the platform for any commercial purpose other than your own classroom teaching.
If you submit ideas, suggestions, or feedback about OctoDecks, you grant us a perpetual, worldwide, royalty-free licence to use and incorporate such feedback into the platform without any obligation to you.
You retain ownership of all lesson content you create within OctoDecks, including slide text, questions, images you upload, and deck structures ("Your Content"). By using the platform, you grant us a limited licence to store, process, and display Your Content solely for the purpose of providing the service to you.
You are solely responsible for ensuring that Your Content does not infringe any third-party intellectual property rights and complies with all applicable laws. You must not upload or include content that is unlawful, obscene, offensive, or harmful.
Student responses submitted during live sessions are not permanently associated with individual students (no student login is required). Anonymous session response data may be stored temporarily to display live results and may be deleted after the session ends.
We may offer a free trial of OctoDecks ("Free Trial") that allows you to access a limited version of the platform without a subscription. The following conditions apply to Free Trials:
Individual teacher subscriptions are billed annually. By subscribing, you authorise us (via our payment processor, Stripe) to charge the applicable fee to your payment method at the start of each billing period.
School and departmental licences cover a specified number of teacher accounts as described on the pricing page at the time of purchase. Licences are non-transferable between schools or organisations. Adding teachers beyond the licensed number requires an upgrade.
Subscriptions renew automatically unless cancelled before the renewal date. To cancel, contact us at hello@octodecks.com at least 7 days before your renewal date. We do not offer refunds for partially used subscription periods except where required by law.
We reserve the right to change subscription pricing. We will give you at least 30 days' notice of any price increase before it applies to your account. Continued use of the service after the notice period constitutes acceptance of the new pricing.
You agree not to use OctoDecks to:
We reserve the right to suspend or terminate any account that we reasonably believe is in breach of this section, without notice and without refund.
We are not responsible for any loss of lesson materials, deck content, session data, or any other content stored on or processed by the platform, whether caused by:
The auto-backup feature (where available) is provided as a convenience and does not constitute a guarantee of data persistence. We strongly recommend keeping local copies of all lesson materials you cannot afford to lose.
OctoDecks is operated by Objects and Concepts Limited, a small independent company. We aim to keep the platform available at all times but we make no guarantee of uninterrupted, error-free, or continuous access. The service may be unavailable from time to time due to planned maintenance, software updates, or circumstances entirely outside our control. Where planned downtime is necessary, we will endeavour to give reasonable advance notice.
We are not liable for any loss, disruption to lessons, examination preparation, or inconvenience caused by service unavailability, whether planned or unplanned.
OctoDecks is built on Google Firebase, a third-party cloud infrastructure platform operated by Google LLC. The availability, reliability, and performance of OctoDecks is therefore partly dependent on Firebase and Google's own systems, over which we have no direct control.
We are not responsible for any service disruption, data unavailability, or outage caused by Firebase, Google Cloud, or any other third-party infrastructure provider. This includes but is not limited to:
Google publishes its infrastructure status at status.firebase.google.com. In the event of a Firebase outage, this is the authoritative source of information on the cause and estimated resolution time; we have no additional visibility beyond what Google publishes.
OctoDecks is designed with classroom continuity in mind. Once a lesson deck has been loaded into the Author or Presenter view, the core lesson content, including slides, activities, and teacher controls, continues to function without an active internet connection. A connection is required only to:
In the event of an internet or Firebase outage during a lesson, teachers can continue to present slides, view slide content, and run activities in offline mode. Student participation features that depend on real-time data sync will be unavailable until connectivity is restored.
We strongly recommend that teachers load their deck before the lesson begins and keep a PDF export as a contingency backup, particularly for high-stakes or examination-preparation sessions.
OctoDecks is developed, maintained, and supported by a small team. As such, response times for support enquiries, bug fixes, and planned maintenance may be longer than those offered by larger software providers. We will always endeavour to resolve critical issues as quickly as reasonably possible, but we cannot commit to specific resolution timeframes. No service level agreement (SLA) is provided unless separately agreed in writing.
To the fullest extent permitted by applicable law, OctoDecks is provided "as is" and "as available" without any warranty of any kind, whether express or implied. We do not warrant that:
Nothing in these terms affects any statutory rights you may have as a consumer under UK law that cannot be excluded or limited.
To the fullest extent permitted by applicable law, our total aggregate liability to you in connection with these terms or your use of OctoDecks shall not exceed the total fees paid by you to OctoDecks in the 12 months immediately preceding the event giving rise to the claim.
In no event will we be liable for any:
This limitation applies whether the claim arises in contract, tort (including negligence), statute, or otherwise, and even if we were advised of the possibility of such loss.
You agree to indemnify, defend, and hold harmless Objects and Concepts Limited and OctoDecks from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the platform in breach of these terms; (b) Your Content infringing third-party rights; or (c) your violation of any applicable law or regulation.
You may stop using OctoDecks at any time. To close your account and request deletion of your data, contact us at hello@octodecks.com.
We may suspend or terminate your access to OctoDecks at any time, with or without notice, if we reasonably believe you have breached these terms. On termination, your licence to use the platform ends immediately. We may delete your account data after a reasonable retention period following termination.
Sections 3, 4, 8, 10, 11, 12, and 15 survive termination of these terms.
We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice in the application. Your continued use of OctoDecks after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the service.
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating any formal legal proceedings, we both agree to attempt to resolve any dispute informally by contacting us at hello@octodecks.com in the first instance.
